Sophia Stewart Re-Files As World's Film Producers Fight To Produce Terminator 4 - Adding Names To Th

In what seemed like an endless nightmare, the Sophia Stewart's Terminator and Matrix Case finally changed courts and came to Salt Lake City August 2007.

In this very interesting court case Stewart has added her 4 lawyers to the RICO case, these were her counsel during the early court trials of 2004 and 2005.

Stewart alleges that her former 4 lawyers Michael Stoller an attorney in Beverly Hills, Jonathan Lubell an attorney on fifth avenue in New York, Gary Brown an attorney in Pasadena California, and Dean Webb an attorney in Vancouver, Washington, and John Does and several others, are individuals and corporations that assisted Sophia Stewart's 'Defendants in accomplishing the various breaches, acts, omissions and others leading to improper treatment in court, in the process Stewart was denied justice. Stewart’s defendants (her former attorneys) had her ‘copyright infringement case dismissed because of the defendants (the 4 attorneys') malpractice, negligence, conspiracy and breaches of contract’.

This is a case in which the 4 new defendants (lawyers) defended Stewart’s defendants and made Stewart trust them to look like they were on her side.

The 4 lawyers were running the Sophia Stewart’s case against Andrew and Lawrence Wachowski, James Cameroon, Joel Silver, Twentieth Century Fox Film Corporation a Delaware Corporation, Warner brothers and others. These wilfully infringed Stewart’s copyrighted literary works by making and distributing the Terminator 1, 2 & 3 ' and they did the same when they took Stewart’s copyrighted works and produced and distributed the Matrix, the Matrix Reloads and the Matrix Revolutions.

Amazingly two young lads, some people say it is the Wachowskis on a new move, joined the defendants row when they recently purchased the Terminator movie rights. According to Derrick Anderson and Victor Kubicek the owners of Halcyon at their site they state that they bought past and future rights of the Terminator franchise; www.halcyon.com "These rights include the right to produce any future Terminator films, as well as all future franchising and licensing rights, certain future revenues derived from Terminator 3: Rise of the machines, as well as certain rights in the television project The Sara Conor Chronicles and the sole right to produce all future Terminator projects in any new or existing media."

Asked why Andrew Vajna and his co-worker also called the ‘Terminator defendants’ could sell the Terminator Rights when there is a huge case going on? Sophia Stewart says: It is because the defendants’ lawyers lie to their clients... they lied to them thus they do not realise the outcome'.

The Halcyon men seem to be in the know and ready to clean up the mess were others failed? But if they rushed to buy the T3’s rights would they rush to give Sophia Stewart her reward and her rights back? In their own words Derrick Anderson and Victor Kubicek say: "While we have several other projects in the works, we see this global franchise as a cornerstone of Halcyon’s future business plans." They see T3 as their business and not Sophia Stewart’s who fights to get her T1, T2, and T3 rights back?

The T4 which should be released early 2009 by Halcyon Derrick Anderson and Victor Kubicek the proud owners of the Terminator rights may end up in a huge surprise to realise that their global franchise is not only a crime but also a RICO case, which adds up Halcyon to the FBI's Terminator list of Stewart’s defendants.

The case is to be settled within 30 days counting to September 2007 or it will go to trial, all depending upon how the defendants react.

In this global franchise people are watching, people are asking questions, 'how come we hear about the new writers for T4's 2009 production yet we never hear about the justice given to the original true author of T1 & T2, movies that helped to produce T3? One thing is certain, Sophia Stewart is going to make 2007, a very busy year.

HIV Denialists or HIV Evangelists?

In a yesterday’s article from EUREKALERT online titled " HIV denialists spread misinformation online -- consequences could be deadly;" told how AIDS denialists spread false ideas and much more. After reading the article at Eurekalert Mr. E. Mugumba reacted to Andrew Hyde and Tara Smith's article. The article read:

While it may be intellectually appetising for all of you to wage this war between apologists and denialists, just because we are stigmatised and discriminated against for being African we are not as stupid as one might think. You may believe that you are winning the" war on AIDS" despite $200b spent on "research", no safe vaccine, no safe treatment and no cure while all predictions have failed. Well, ok, researchers are winning but at Africans expense.

Just underneath the surface most thinking people in Africa acknowledge that UNAIDS figures are based only on one-time tested blood from pregnant women at anti-natal clinics and that pregnancy is the primary factor known to cause false-positive results. They also know the differences between harmless antibodies and deadly pathogens, that the conferences are chiefly drug marketing events, that the mighty politicians, celebrities and philanthropists are having a field day rejuvenating their reputations at the same rate as extending their tax deductions, that condoms cause infections, that the microbicide trials have not just failed, but failed to the point where antibody negative women are now positive (the consolation is free toxic drugs for life), that all reporting on AIDS is biased in favour of the industry, that abstinence campaigns will fail despite the amount of discordant couples grows, despite Africans being much less sexually promiscuous than Westerners (I am thinking of the Kaye Wellings study published in The Lancet last Autumn) and it goes on and on....

The latest in Uganda is that the president's legislators are working around the clock for the next two months to introduce the death penalty by hanging for anyone deemed HIV positive who has sex with another person without disclosing his or her serostatus. Verbal consent will not be considered proof. I think I read that the same policy is being adopted in three other African countries.

African herbalists having great successes in treating immune deficiency are very quickly hailed as quacks, con men, dangerous and collectively a menace, especially when the patients become large in numbers and report their happy stories to reporters. The breakthroughs are published in their true light after which the authorities get to hear about them and turn the media against its own people. This also happened to a Rwandan herbalist I had heard about and went to visit in a tiny village not too far from Gitarama. Isidore Mahoro is still known by everyone in Rwanda as the only man in the world with a cure for "AIDS" in hundreds of patients (including 6 Westerners) for a moment in 2004 and in the next moment he was branded and thought of as a fraud. A sample of his potion was sent to Germany for tests. Six weeks later the result was that it contained nothing unique, just olive oil, honey and milk mainly. Yet nobody had ever stated that his treatments did contain anything uncommon. In the meantime there are upwards of 2000 AIDS organisations operating out of a sense of good intentions but ignorantly in Rwanda and upwards of 6000 in Uganda and yet Western AIDS activists in Africa blatantly lie by saying that there is a negligible incidence of AIDS at home because of education, implying that we adhere to safe sex.

These catastrophic numbers of AIDS organisations are neither a sign of the armies employed believing that they are preventing anything nor are they a sign that our governments are more corrupt than yours, but a sign of people accepting a job just because it is a job, because the idea has been put into peoples' minds that they need money to live, which never used to be the case.

Imperialism works in increasingly mysterious ways every time. Our governments' officials have their hands in each others' pockets, you get to play the good guys and we the poor victims. I have never met a Westerner in Africa that was not there but for his or her own benefits, which come in the form of relatively highly paid holidays with cheap booze, tobacco, dope, reverence all around. Those who immigrate exploit poverty typically by selling religion, cheap alcohol or buying up land and putting up a fence around it often in the belief of being compassionate. All the while our countries are rich, yet about 60% of Sub-Saharan Africans continue to live and die without safe drinking water, adequate nutrition and sanitation. There's no funding nor interest in these things because they are not profitable.

Is it true that USA accounts for 20% of the world's population and yet its people consumes 80% of the world's resources? What must the people look and think like if this is true? The fear of mass explosions may be based on a wrong premise if you are your own worst enemies. And you are imposing this lifestlye on to other countires. Cui bono?

It upsets me so to see Africans perish even more now since the AIDS band wagon began to roll that has been put in motion by people from another continent who spend the good part of their lives killing themselves with their addictions and pollution. I am currently visiting Europe for the first time and am shocked and aghast at how you Westerners "live" to work to smoke and drink, eat and borrow to get stressed, sick, complain and rationalise. You are so clever with your education, high profile jobs and creditworthiness, but your generations are estranged, you put your kids in front of the TV because you don't know what else to do with them and then wonder why they become insatiable consumers.

You put your parents into old folks homes because it is normal without stopping to think that that will be you one day. Anything goes wrong with the car you have to call someone to fix it, anything goes wrong with the body you have to call the doctor, anything goes wrong with the kids you have to see a paediatrician, anything goes wrong with the marriage you have to see a lawyer, and its always someone else’s fault. Blame, blame, blame, making each other feel guilty to boost the ego. And you call us dependent!

Well, we Africans never accepted the blame for spreading any virus across a continent to your vast homosexual communities, in fact we never had sex with the monkeys, we have always been less sexually promiscuous than you and you have always had more from us than you gave (and in the form of Trojan horses). Foreign aid to Uganda is one big Trojan horse, but in any case it still only represents one third of the amount going out of the country in terms of worth of natural resources and minerals.

Simplicity

SS wrote a treatment entitled the Third Eye on May 1, 1981.

The treatment was disseminated to Fox on or about May 4, 1981.

SS copyrighted the Third Eye before the Terminator screenplay was copyrighted in October of 1984.

The first minute and 45 seconds of the film released in October of 1984 entitled the Terminator in association with Pacific Western Productions, Inc. reads on the language of the May 1, 1981 treatment by SS.

Pacific Western Productions, Inc. was started by Gale Ann Hurd on May 12, 1981. Exhibit ___.

On information and belief, Hurd hired the incorporator, James R. Miller on or before May 10, 1981 to prepare articles of incorporation that were filed under number 1043898. Exhibit ___

On information and belief, Gale Ann Hurd obtained access to the Third Eye through Fox, its agents and affiliates, between May 4, 1981 and May 10, 1981. Affidavit from _______.

On information and belief, Gale Ann Hurd then made use of the Third Eye in the first minute and forty five seconds of the Terminator film. Transcript of Third Eye from May 1, 1981 and video copy of the visual dialogue of the first minute and 45 seconds.

To cover up the unauthorized use, Gale Ann Hurd omitted in reference to that use in the screenplay entitled the Terminator with U.S. Copyright office under Pau ______ when the same was registered in October of 1984.

Because the registration with the Copyright Office did not disclose the use of the Third Eye to the Register of Copyrights but the use is plain and did not disclose SS's authorship as required by 17 U.S.C. 201, the registration is materially false and deceptive on the Copyright Office and should be deemed a nullity. [18 U.S.C. 1001]

The film that was released used the May 1, 1981 treatment by Sophia Stewart in the first minute and 45 seconds of the film.

In an effort to mislead the Court, persons affiliated with PWP failed to disclose to the Register of Copyrights that known use in an effort to wrongfully receive a copyright over material obtained by improper means from the May 1, 1981 copyrighted treatment by SS registered under Txu 117-610.

By this action, defendants wrongfully and intentionally infringed the copyright of SS in violation of 17 U.S.C. 506 and 18 U.S.C. 2319.

Then if complicated RICO theories were desired if should depend from this simple statement which should be supported by references.

This is not how I would have written it but a short hand statement of a short and plain statement of what was wrong properly supported so that no judicial official could have properly dismissed the claim under rule 56. Such a plain statement would have preserved it.

After that, claims that depend from that foundation would have been stated.

The FBI would have looked for related criminal offenses from this simple outline of facts.

A person that denied access to the May 1, 1981 treatment would have a difficult time proving that assertion with the film compared with the screenplay where those words do not appear but read on the Third Eye which they claim not to have seen. It is like DNA. The presence of the information and the absence of it in written screenplay proves knowledge of misconduct.

Then later one would have shown consciousness of guilt --

""The liability of the directors of the corporation for monetary damages shall be eliminated to the fullest extent permissible under California law."

What was the purpose of the March 25, 1992 amendment? Could it have been concerns that litigation would have pierced the corporation by showing that some directors knew of the circumstance?

The last inquiry would be to find out what happen to the career and circumstances of James R. Miller. Is he now living in the Camen Islands, Paris, or Italy? Is he in another field? What happened to his secretary? Where does she live? Why did your attorneys not get an affidavit from the secretary of James R. Miller showing the date that Gale Hurd OR SOMEONE ELSE ARRIVED ASKING TO INCORPORATE? WHO WAS THAT PERSON?

YOU DON'T NEED ATTORNEY CLIENT PRIVILEGED STATEMENTS. THEY ONLY NEEDED TO SHOW WHO SHOWED UP. THEY DID NOT FIND OUT WHETHER IT WAS SUSAN MERZBACH WHO MAY HAVE PAID THE BILL FOR THE MATTER. WHOEVER DID IT, THERE IS BIG INFORMATION IN IT.

YOUR ATTORNEYS FAILED TO FOLLOW THE EVIDENCE THAT COUNTED BOTH CORPORATELY AND ARTISTICALLY AND THEREFORE YOU WERE DAMAGED BY THE OUTCOME.

THESE ARE THE QUESTIONS THAT SHOULD HAVE BEEN ADDRESSED. BEFORE RICO IS USED, ONE MUST BE ABSOLUTELY CLEAR THAT EVERY ELEMENT OF THE OFFENSE IS MADE OUT BY A PREPONDERANCE OF THE EVIDENCE. FOR COPYRIGHT RICO, YOU NEED TO HAVE NOT LESS THAN WHAT I HAVE DESCRIBED ABOVE.

IN ALL THAT WAS SAID, THERE IS NOT A PLAIN STATEMENT OF WHAT THE ACTUAL ACCESS AND USE WAS AS IS STATED HERE.

1. Gale Ann Hurd, in 1981, was an administrative assistant to Roger Corman of New World Productions, Inc. that was based in Venice, California. Wikipedia Encyclopedia
2. Susan Merzbach, in May of 1981, was the vice president of Creative Affairs for Fox. June 1, 1981 letter from Kay Harrison of Fox to Sophia Stewart confirming prior receipt of the screen treatment entitled the Third Eye
3. On May 1, 1981, Sophia Stewart completed the screen treatment entitled the “Third Eye” which concept was placed in 2019 after horrible nuclear wars and a spiritual evolution was underway due to conflicts between those who were spiritually based and those that were technologically based, and this conflict led to a war between highly sophisticated machines brought about by highly skilled weapon systems scientists and humans. The war involved the use of interplanetary space travel through an advanced machine that functioned from the planet commanded by Queen Johnny called Spacestar that functions totally through cybernetic ally made machines that functioned through highly sophisticated micro chips. Each is programmed to achieve a particular function connected to warfare. Some are programmed to kill. One planet that engages in warfare with the main character who has been touched by a spiritual happening is Ikahn, a warrior. It is through this conflict that he is forced to take up arms against those on earth that are in pursuit of a spiritual life when he is forced into conflict with the machines that operate without emotion or conscious. The engagement takes place between those with spirit and those with the seed of life go unencumbered by the highly programmed machines that are almost able to reason so as to conflict with the leadership of man that is grounded in spiritual thought. This is a summary of the May 1, 1981 screen treatment by Sophia Stewart.
4. In May of 1981, the subject matter of fact 3 was in the hands of Susan Merzbach of Fox who spoke with Sophia Stewart about the content in May of 1981. June 1, 1981 letter from Kay Harrison of Fox to Sophia Stewart
5. Susan Merzbach had physical possession of the Third Eye in May of 1981 with the consent of Sophia Stewart, but she did not have ownership of the story. [A constructive trust is imposed when a defendant has possession of property that in good conscience belongs to another.. Knieniem v. Group Health Plan Inc., 434 F.3d 1058, 1064 (8th Cir. 2006).]
6. Sophia Stewart was the equitable and legal owner of the story described in the treatment dated May 1, 1981created by her.
7. A Phi Beta Kappa graduate of Stanford University, where she majored in economics and communications, Gale Ann Hurd learned the ropes of filmmaking from the inimitable Roger Corman. From 1977 to 1982, Hurd was in charge of marketing and publicity for Corman's New World Pictures. [Hal Erickson, All Movie Guide Blockbuster]
8. As Susan Merzbach had possession of the Third Eye in May of 1981, Gale Ann Hurd, a specialist in marketing and film publicity for Corman’s New World Productions, in Venice, California, caused articles of incorporation to be filed with the Secretary of State of California for the company named Pacific Western Productions, Inc. on May 12, 1981 under registration number C1043898.
9. The document that was in possession of Susan Merzbach came into possession of Gale Ann Hurd without the knowledge, consent, authority, or compensation of Sophia Stewart. July 1982 screenplay written by James Cameron has the features described in number 3 above
10. The first one minute and 45 seconds of the Terminator film read on pertinent parts from page 1, 2, 3, 4, and 5 of the Third Eye disseminated by Sophia Stewart to Merzbach of Fox prior to May 6, 1981.
11. The Third Eye six page treatment was registered with the copyright office on February 2, 1983 as registration number Txu 117-610.
12. Between May of 1981 and December 31, 1981, Gale Ann Hurd engaged James Cameron to use the subject matter that she had provided to him from the Third Eye to make a story that utilized those elements into a screenplay for production while she and James Cameron were both openly employed by New World Productions, Inc.
13. James Cameron was able to obtain training and experience by watching Roger Corman work on the film known as Galaxy of Terror in 1981 as the unit director while he simultaneously worked for Pacific Western Productions, Inc. in writing the screenplay that he entitled “The Terminator”.
14. Before James Cameron was hired by New World Productions in 1981, he directed Piranha II: The Spawning and received horrible reviews for the work and was fired on account of the absence of quality in the work product.
15. After Susan Merzbach, reviewed the May 1, 1981 treatment by Sophia Stewart, a person who was not then a registered writer with the Writer’s Guild of America, she considered the concept to be exciting but did not know about the availability of a writer/director who worked with robots.
16. Merzbach got a list of films that classified works done involving the use of robots and identified Xenogenesis, a 1978 12 minute film short by James Cameron at USC film school, and concluded that he had the capacity to direct a sequence with robots and could also contend that he originated the story concept because of that prior film short.

Some aspiring directors produce a short film in an attempt to persuade studios to let them direct. Former production executive Susan Merzbach says a good short will convince her to hire a director. "I'll hire you as a director the moment I can see that you can direct," she says. "Show me that you're talented. All I need is proof that you can do it."
But most executives and producers are reluctant to hire someone to direct a full-length feature on the basis of a short. After making several impressive shorts at UCLA, writer-director Colin Higgins showed his work to executives and was uniformly told: "Well that's terrific.... You can do short films, that's what it proves." No one was willing to let him direct a feature.
18. Xenogenesis, the 12 minute robot film from 1978 at the USC film school by Cameron, satisfied Merzbach’s business practice.
19. After the May 1, 1981 treatment was reviewed by Merzbach, Roger Corman, after conferring with Merzbach, hired James Cameron to work at New World Pictures after having received atrocious reviews, Gale Ann Hurd, then also a New World Productions, Inc. employee, quickly requested Cameron to prepare the screenplay for the Terminator using the treatment by Sophia Stewart through the new company called Pacific Western Productions, Inc. that came into existence by her efforts while working for Roger Corman of New World Productions, Inc. on May 12, 1981. James Cameron was employed as a unit director on Galaxy of Terror, all of which was done to give him time to write the screenplay that could be registered with the Writer’s Guild of America and eliminated the impediment that Merzbach saw with Sophia Stewart.
20. There is no law of the United States that requires any person to be a member of the Writer’s Guild of America to sell a screenplay under 15 U.S.C. 1, 17 U.S.C. 106, or 18 U.S.C. 241 in that writing and communicating are protected by the first amendment and the due process clause protects the right to freedom of contract regarding lawful activities.
21. Combinations and conspiracies against the right to freedom of association, freedom of contract, and the sale of dramatic works violates the antitrust laws, the copyright laws, and the criminal civil rights laws.
22. A pretext to discriminate against the use of a writer’s work on a reason that is not supported by any valid federal law in light of the First Amendment, Article 1, Section 8 of the Constitution, the Copyright Laws, the only law that supports a lawful restraint on the use of a dramatic published work, and the antitrust laws prevent combinations against free trade in screenwriting in violation of 15 U.S.C. 1, 17 U.S.C. 106, and 18 U.S.C. 241.
23. Sophia Stewart was told by persons in Creative Decision Making positions that a work could not be used unless it was registered with the Writer’s Guild of America or whose agent was not so registered. Published statements of Sophia Stewart
24. 17 U.S.C. 105 and 301 do not permit the state of California to create any law that requires a citizen to get a special status to write or trade in dramatic works.
25. Private entities and entertainment entities do not have the power to create and enforce a rule that would be a federal offense as a 15 U.S.C. 1 “combination in restraint of trade” that functions by “intimidation” under 18 U.S.C. 241 if employed.
26. No lawful impediment exists to prevent Merzbach and Fox from making a contractual arrangement with Stewart regarding the work then known as the “Third Eye” in May of 1981.
27. On information and belief, Roger Corman hired James Cameron on the recommendation of Susan Merzbach. See note 15.
28. On information and belief, Gail Ann Hurd commenced Pacific Western Productions, Inc. on the recommendation of Merzbach and Roger Corman in May of 1981.
29. On information and belief, Merzbach encouraged Corman to teach Hurd how to be a producer at that time for the development of the story even though she was then fully devoted to Marketing and Publicity.
30. On information and belief, Merzbach and Corman had an understanding with each other as to how they would benefit from the encouragement and aid given to James Cameron and Gale Ann Hurd.
31. Gale Hurd was requested to create a trail of publicity that covered the wrongful taking of the story including where and how the Terminator story was conceived, how much the company would compensate the writer for the story, and to totally and completely agree not to disclose any prior review of the story entitled the “Third Eye”.
32. On information and belief, as a condition precedent to Cameron being given the opportunity to direct after Piranha II, he had to agree to write the screenplay, direct, and contend that he thought of the concept on his own away from Gale Hurd and Susan Merzbach.
33. Prior to James Cameron writing the June 12, 1982 screenplay, he reviewed, relied upon, and incorporated elements from the Third Eye into the first draft of the Terminator that he received from Gale Hurd.
34. Purposely, Gale Hurd did not participate in the first four drafts of the Terminator screenplay to distance herself as having been the carrier of the document and concept to James Cameron.
35. Sophia Stewart filed a copyright registration on the six page treatment completed on May 1, 1981 on the Third Eye on February 2, 1983 as Txu 117-610.
36. James Cameron completed his first draft of the Terminator in June of 1982 according to his filed draft in the Writer’s Guild of America as of July 1982 for Pacific Western Production, Inc.
37. The final copyright registration of the Terminator occurred on February 3, 1984 by Hemdale Film Corporation, the claimant, under registration number Pau-584-564 showing as authors Gale Hurd as an employee for Hire of Pacific Western Productions and James Cameron which included a stated creation date of “1983”, which statement was false based upon the first draft submitted to the Writer‘s Guild of America for Pacific Western Productions dated July of 1982.
38. The sole contribution to the work that appears to have come from Gale Hurd is the dialogue from the police officer after Kyle Reese makes his entrance when he asks about the date and the officer responds, “May 12th”.
[This reference was placed in the script to permit Hurd to maintain a contribution to authorship. However, it is too insignificant to the plot or character to constitute authorship within the meaning of the copyright act based upon four drafts solely provided by James Cameron. The only possibility is that she gave him the original document that was transferred to Hurd without the consent of Stewart from Merzbach in violation of section 186.11 of the California Penal Code and 18 U.S.C. 1001.
39. A person cannot maintain authorship unless he or she contributed to the development of the story concept, characters, action, and plot development in a material way.
40. Hurd’s contribution to the story line was not material.
41. Stewart’s contribution to the story line was material in the first seven minutes and thirty seconds of The Terminator.
42. The first minute and 45 seconds is not scripted regarding a post nuclear war machine versus man warfare. While this subject matter is not in the first draft through the final draft that was registered in the copyright office, it is in the film and it reads directly on pertinent parts of pages 1, 2, 3, 4, and 5 of the Third Eye by Sophia Stewart. It is followed by this language:
The machines rose from the ashes of the nuclear fire. Their war to exterminate mankind had raged for decades, but the final battle would not be fought in the future. It would be fought her, in our present tonight.
This is the end of the introduction of the first one minute and forty five seconds of the film which precedes the film credits. It includes an interplanetary space travel hover craft that fights with laser guided technology from the research and development war project described in the Third Eye. It includes a dark war scene with cyber operated robots engaging human soldiers in warfare. This setting, writing, and screenplay does not appear in any draft but is included to establish the basis of the entire film. Thus, the conceptual basis of the entire film concept is the Third Eye. However, the specific unscripted use of the Third Eye which is not subject to reasonable dispute is the first one minute and forty five seconds.
Words from the Terminator Film that are not Mentioned in the Final Script
“The machines rose from the ashes of the nuclear fire. Their war to exterminate mankind had raged for decades, but the final battle would not be fought in the future. It would be fought her, in our presence tonight.”
This description is preceded by a dark showing of a war scene that included the introduction of an interplanetary hovercraft that operated with laser guided munitions and was accompanied by land operated rover equipment. Men were involved in war with the machines that laid the foundation for the conflict with the Terminator, Kyle Reese, and Sarah Connor.

Legal Principles Violated

Merzbach received actual possession of the treatment in May of 1981 and was the sole author of the work. This matter was registered in February of 1983. The possession of Merzback for Fox was a constructive trust in favor of Stewart. Merzbach breached that constructive trust when she exposed the concept to Hurd and Corman without Stewart’s knowledge, consent, or approval. A constructive trust is imposed when a defendant has possession of property that in good conscience belongs to another. Knieniem v. Group Health Plan Inc., 434 F.3d 1058, 1064 (8th Cir. 2006).
Neither Merzbach nor Hurd can prove that they did not copy or use the May 1, 1981 disclosure within the corporation commenced conveniently on May 12, 1981, Pacific Western Productions, Inc. Only a voluntary disclosure to the actual offender without evidence of copying precludes the claim. Clancy v. Metro-Goldwyn Pictures Corp., 37 U.S.P.Q. 406 (D.C.N.Y.)
The first 7 minutes and 30 seconds have the time setting, the conflict between man and machine, the interplanetary travel feature, the spiritual concept of destroying the vision of the savior who comes to oppose evil from others through the Mary and Jesus Christ Concept [around John Connor -- JC], and the ending with mankind triumphing over a machine dominated regime as described in the Third Eye.
The selection of James Cameron was consistent with the business practices of Susan Merzbach as stated by her own words. She will use a short. Xenogenesis, a 12 minute 1978 film on robots by Cameron, compelled his selection. He was the only novice director who could claim he had dreamed about robots when he had not. Thus, the discussion about him being paid $1.00 by Pacific Western Productions for the script after doing five drafts of the June 1982 document for Pacific Western Productions is unrealistic. He did not have to give the script away to direct. He had to write and direct the project to keep costs down and to make the publicity being made by Gale Hurd to cover up the theft plausible.
Examples of the publicity manufactured by Gale Hurd are as follows:
1) James Cameron had a dream about robots in Italy;
2) James Cameron inadvertently came to New World Productions from Italy;
3) James Cameron was brought to New World Productions to work on Galaxy of Terror when in fact he was working on the development of the story for the Terminator from the Third Eye but was paid through New World Productions;
4) Merzbach did not play a role in Cameron being hired by New World Productions in 1981;
5) that Cameron had to sell the script for $1.00 to get to direct when in fact that was an effort to keep actual damages down in the event that they were sued for copyright infringement;
6) That Cameron and Hurd married for love, when in fact it was a means for them to share the story revenues from 1985 and 1989 in Pacific Western Productions that he appeared to give away for no royalties in order to direct.
In Dezendorf v. Twentieth Century Fox, 99 F.2d 850 (9th Cir. 1938), the author of an unpublished play that charged the defendant with literary larceny prevailed when he showed that defendant actually used his work product to make the infringing product.
Analysis
The unpublished treatment written Sophia Stewart was placed in the possession of Susan Merzbach for the benefit of the shareholders of Fox and her. No offer was made by Fox through Merzbach. Within a few days of disclosure, Merzbach’s possession became a basis for a corporate formation by Gale Hurd, then the marketing and publicity assistant to Roger Corman of New World Pictures. Hurd commences Pacific and Western on May 12th, 1981. Then efforts are made to get James Cameron, then an unsuccessful film director of Piranha II to come to New World because he had the profile of a robot film director from Xenogenesis. These combined activities and strategic alignments are evidence that the work was copied, modified, used, and that an elaborate cover up was established to use the work product and to mask the sharing of money about the script.
Conclusion
There is sufficient evidence to maintain that a wrongful taking of the May 1, 1981 treatment occurred in May of 1981 as to the first minute and 45 seconds of the final Movie of the Terminator and this use was obtained by the wrongful misappropriation, embezzlement, copying, and publication of the exclusive use rights of Sophia Stewart without her consent or compensation by Gale Ann Hurd and Pacific Western Productions, Inc.

The Pressure Point
Persons in the entertainment business often consider the filing of a copyright registration a matter of formality. However, authorship cannot be given to an editor. It is reserved for those that engage in original authorship that significantly develops the plot, a character, a theme, and conflict resolution. Minor editorial factors and less significant action for marketing purposes does not satisfy this characteristic. For example, a film with no black actors involved is a business consideration, not a plot consideration. The police lieutenant in draft one was a White character. The police lieutenant in the final draft was a black character. This is not a matter of thematic consideration. The opening scene has a cat next to the dumpster in all versions including the fifth draft.
A source less wind rises, and with it a keening WHINE.

When the movie is done, the opening scene involves a black sanitation worker who sees the bright light, LIGHTNING FROM PAGE 4 OF THE THIRD EYE, NAKEDNESS WITHOUT SHAME FROM PAGE 5 OF THE THIRD EYE, and then the sanitation black sanitation worker abandons his truck as “the sound of stray electrical crackling subsides“ with a thing appearing to be a white “naked man“ arrives crouched like the Thinker stands who was “powerfully built“.
The first draft completed in June of 1982 described the man that arrives here as powerfully built.
This does not appear anywhere in the screenplay. However, this permitted the audience to see two black male actors in the film. No other black person was portrayed in any other social setting in what was supposed to be Los Angeles, California in 1984. These business choices for marketing purposes did not change the plot, theme, action, or constitute a significant contribution to authorship by Hurd.

The subject matter used from Stewart was significant and therefore she should have received a screen credit and royalty payments. The initial one minute and 45 seconds comes from and reads on the language of the Third Eye in pertinent part from page 1, 2, 3, 4, and 5.
Hence, the disclosure of Gale Hurd as an author on the copyright registration appears to be a materially false statement regarding the registration that violates 18 U.S.C. 1001 and permitted her to wrongfully acquire an interest in the script for payment purposes thereby, which fraud was achieved by a false statement to the Copyright Registrar.

Gale Hurd did not create the introduction of one minute and forty five seconds. They did not write into the script. The introductory setting is not in any draft. It does appear in the film. It is the undeniable proof of willful copyright infringement in violation of 17 U.S.C. 506. It is the undeniable proof of an illegal copyright registration in violation of 18 U.S.C. 1001. It is the undeniable proof that neither Cameron nor Hurd created the setting under which the Terminator was written.

HIV/AIDS IN U.K

For a long time, no one has come up to question the figures claimed, that a worrying number of Africans in U.K have been found with HIV. No one has come up to question all the dead claimed to have been killed by the HIV in U.K. It is a political correctness that has gone so wrong and it has made the African community in U.K very angry and resentful to the rest of the community.

Are we being misled by these groups of people who are claiming to fight for those infected by the deadly virus? Something has to done to save the innocent Africans and other communities who are being terrorised by their own in the name of saving them from the deadly virus.

In 1998 the Health minister Tessa Jowell rejected the testing of all pregnant women in U.K, instead she suggested testing African pregnant women and the women of drug use history living in U.K. At the time Mrs Cherie Blair the prime minister’s wife was pregnant, as usual I asked my friends at Continuum; will she be tested for the virus and to my surprise their reply was yes. I said; no way, they are just looking for a way to punish more African women through the drug-use-history.

In U.K, unlike other illnesses, HIV/AIDS testing and its diagnosis is protected by some rules and regulations. To my knowledge these rules have only protected the abusers of the whole HIV/AIDS system. Confidentiality means you don’t have to tell or disclose someone’s HIV + status or name them. Instead HIV/AIDS organisations came up with different ideas like using codes instead of their client’s real names.

In schools, work places, swimming pools, hospitals, nightclubs and all public places names are not mentioned. For a long time even husbands were not informed of their wife’s HIV status and vice versa until 1995, all this was in the name of protecting the patient’s identity and dignity. It is only today that they are imposing telling real names to the patient’s GPs and other care providers.

It is not going so well among those concerned. Previously HIV positives were named in codes or numbers so that their identities were not disclosed, but this only gave way to some fraudsters who defrauded the system by claiming numbers that never existed to get more money from AIDS charity fund, Local Councils and many Healthy agencies around U.K. Many innocent lay people who cared enough to help also put in a lot of money to save people around the world from being infected by the HIV virus and from dying of AIDS. The same rules and regulations were put in place to save HIV positives. HIV+ people are supposed to be protected from the stigma, prejudice, isolation, discrimination attached to the HIV diagnosis and being vulnerable to discrimination, abuse, homophobia and so forth. Some groups of Africans have their own interest and in a very disturbing way. The public is unaware of what is going on behind closed doors of these African HIV/AIDS charity organisations.

The numbers claimed in statistics in U.K of Africans with HIV are entirely based on fabricated numbers and more has to be done to put things right. The public is misled by the claims put to them. Let’s not stop asking the right questions because of political correctness. There is no accountability in this field and so far many African HIV/AIDS organisations have closed due to failure to comply with the rules put in place to protect the public funds. I do not know anyone who have been brought to court for this. Instead some Africans have been charged of infecting others with the virus.

A lot of money was put in all HIV/AIDS agencies to protect the individuals and groups of people infected by the virus. More was also put in promoting HIV/AIDS awareness among Africans. What about the rest of the community? The NHS is being pushed to its limits to cope with the demands of HIV/AIDS among African people living in the U.K many of them Asylum seekers and migrant workers. Some services are being cancelled because of luck of funds available to the NHS. This includes pre and post counselling to HIV testing, home care and so forth.

The HIV test itself is very expensive and dosen't come cheap with what goes with it. In U.K, Gay men, Drug users and Sub-Saharan Africans are classed as high risk groups and they are the only group tested for HIV unless otherwise.

As early as 1989 a number of Sub- Saharan Africans came here after fleeing their countries of origin. They were from Uganda and later in the early nineties more came from Kenya, Tanzania, Zambia, Zimbabwe and so forth. The South African migrant professionals came to work here on working visas.(I don't understand)

Originally the West Africans were not classified as high risk, but of recent they have been added on the list. Social services are at break point to cover these disabled people and those dying of HIV/AIDS.

Many Africans who are here on working visas are tested for HIV after arriving here in U.K only to find out that they are HIV positive. I’m not sure what plan is in place for them after their positive results. All I know is anyone found to be HIV+ will find him or herself in constant tests associated with HIV. These are the infections in the world of HIV/AIDS, but in other areas these are normal infections that are normally treated without problems. HIV positives in U.K are bound to find their lives turned to the world of medicinal drugs, hospitals, hospices, detentions and fighting deportation. This is because they are told that they didn’t disclose their HIV status while applying for their working visas to the U.K. This high lights the Australian Prime minister’s (http://news.wtnrradio.com/story.php?story=173) comments that HIV positives don’t have a place in Australia because they will never be able to work so they are of no use.

Many argue that they were tested for the virus before they came to U.K and were found to be HIV negative. These individuals are not aware that HIV testing is very different in many ways. It is also known by many Western agencies that Africans use poor quality HIV test kits. The questions to ask are: Who makes these cheap test kits? Why are they allowed to be sold? You can be HIV positive in U.K and be negative in Australia, but because HIV testing is not compulsory in U.K it is not usually questioned. Asylum seekers, Eastern Europeans, South Americans and Asians have also found themselves among the HIV/AIDS victims. Service providers are claiming that even groups of people who have never been found to be HIV are now being found to be HIV positive. These are the Muslims communities of Indian and Arabic origin and the young Black British. Where are their white counter parts in all this? How smart is this HIV virus that chooses only a certain group of people here in U.K and on the African continent?

Today the British councils around the world are announcing HIV testing if you are travelling to the U.K and one wish to obtain a visa. Australia has stopped HIV positives to travel to Australia. America has only uplifted its stop on HIV positives to travel to the States. The President of The Republic of Uganda supports death penalty for those who infect others. Bill Clinton called for those stealing HIV/AIDS money to look somewhere else to steal from. The bill to charge the HIV positives defiling children has just been past in the Ugandan parliament.

What about the adults? (is the question relavant or do you need to elaborate a bit more)

While being HIV in U.K made disabled people and those suffering chronic illnesses jealous of how the HIV/AIDS victims were treated. HIV positives were treated favourably and the rest of the disabled groups and those with other illnesses were not. It caused a lot of anger among the service providers and those who felt that Asylum seekers and migrants take their benefit system for a ride. The Africans that were not in the HIV+ group were not happy and wondered why their fellow Africans were treated favourably. While the African and Gay men HIV/AIDS victims or disabled people were in constant pain and many were dying, little sympathy went to them because of what was easily given to them.

I do not think this kind of help (through drugs) was easily given to the HIV/AIDS positives despite their testing and diagnosis. I just know what kind of resentment it has caused among the community service users and providers. For years I have raised these issues but fall on deaf ears. Unless the community is aware of what is going on, and not blocked by the so-called confidentiality rules we will not save our NHS. HIV/AIDS money will not be saved from being abused by fraudsters in the name of saving African HIV positives. Many Asylum Seekers and Eastern Europeans migrant are not aware of what is going on. They have to be saved from this very sad situation and more questions should be asked instead.

My wish is to see things change for the better and fraudsters stopped from continuing their crime that is hidden behind HIV/AIDS confidentiality rules.

COLONIZSATION AND RECOLONIZATION
PART I

Q: Today a lot of young Africans who have grown up after the period of colonization, do not quite clearly understand what colonisation was, how it was carried out for whom and why. So my first question to you Mr.Agami is, could you explain your understanding of the background and nature of colonization ?

Ans: The question of colonisation is not an easy one to answer. However, it is an issue in relation to the people of Africa. The backbone of colonisation started with slave trade and slavery in Africa. To be exact it starts from 1440 AD, it went up 1840 AD.

In short, 400 years of slavery in Africa. Where the Black people were taken to go and work in America, Europe and the Middle East. That is the background of colonization.

Then from 1850, started the true colonisation, where the people of Africa were colonised by Europe. The objects were three, one was the so – called Civilization of the Africans, the second was Christianization, to make Africans Christian, the third was the Commerce, the trade. So if you are Civilized and Christian, then you have you have trade. This was called the three C`and was the background of colonization.

The reason was simple. The Africans fought hard against slave trade. It wasn’t an easy issue, simply picking the Africans. It involved war, destroying villages, catching the victims or selling them, taking them to the coast and later taking them by ship to America.

So many died, out of 10 slaves caught, nine of them died on the continent of Africa. And out of all on the boat taken to America in particular, from West Africa, half of them died at sea, because the conditions were bad. Therefore slave trade was found uneconomic, around about 1815, so the pretext that slave trade was a bad thing started and this had to be replaced by enslaving the black people on their continent.

Thus the idea of colonization was developed, which was termed in the meeting in Paris 1875, called the terra nullius resolution dated 3rd August 1875.Whereby the European powers said, the Land of Africa is empty and it does not belong to the people of Africa, the black people, so it has to be taken over.

That is the meaning in Latin, Terra nullius, nullius means nothing. So they were not taking Land from a people, we did not exist. By the philosophy that, black people had been enslaved to them, the Europeans for 400 years, the continent Africa did not belong to anybody, not even the blacks.

This Paris resolution of 3rd August 1875 set the base for colonization and to establish the laws, how to divide the African land among the European powers, a conference which came to be known as the conference of Berlin was designed. It took place in Berlin, in Germany. It started on 15th November 1884 up to 25th febuary 1885.

What was called the General Acts of Berlin or the Treaty of Berlin was signed on the 26th of February 1885. This is the law, the charter that granted the power to the European powers to take any land in Africa and divide it among themselves. Colonisation was born 1885 and continued up to approximately, we can say, 1960, where the philosophy of decolonisation started after the Second World War 1945.

So in brief we should say how do we define colonization? Colonisation is depriving a people of their basic human rights, their political rights, taking away their freedom and enslaving and oppressing them to work, even without pay.

Taking away all their rights and depriving them even of their culture, their language and all that humanity can think of. Coming to the question of Civilization, it means the African way of life is considered primitive; therefore it doesn’t deserve to be retained.

Thus Europeans gave power to themselves, to destroy African culture, to destroy African existing governments. Chiefs were taken executed, deported and everything was set, so that the new future African Blacks are Black Europeans. Behave like white Europeans, eat like them, do everything like them and speak their language. So, this is what is called the colonization of Africa.

I will answer all other questions, after this particular issue which is a brief definition of, What is colonisation ? Which meant in brief, taking all what Africa possessed and administering it by the Europeans.


Q: Which countries were represented at the Berlin Conference and how did they stand to benefit? What were their interests in colonization? What did they wish to gain from this process of colonizing the continent of Africa?


You could say, if you take at that time, we say there were 14 countries roughly, because the other three countries were ruling another three other countries as part of them, as vassal states.

But otherwise you could say 17 countries took part. If I can remember them quickly by heart, some of them, starting with the country where the conference took place: GERMANY, Germany was co-chairman with BELGIUM and Germany’s leader was Bismarck, Otto von Bismarck who was the Chancellor of Germany and for Belgium, the kingdom of Belgium, was king Leopold II

So we say GERMANY, BELGIUM, NETHERLANDS, AND LUXEMBURG, FRANCE, ITALY, SPAIN, PORTUGAL, BRITAIN, SWEDEN AND NORWAY because that time Sweden was ruling Norway, DENMARK, UNITED STATES OF AMERICA, RUSSIA, TURKEY/OTTOMAN EMPIRE it was known as the Ottoman Empire, but today it is known as Turkey, and AUSTRIA

Austria was together with Austria-Hungary and I am sure, if I haven’t forgotten any there should be 17 countries. These were the countries which were present at the Berlin Conference.

Now the question is: what did they hope to gain ? This is an interesting question, part of which I have answered, when I was trying to give the background, which is: the Land of Africa had to be taken by Europeans, becoming European property. It does not belong to the Africans, Terra Nullius, in Latin. So, the African Land does not belong to Africans, but it belongs to Europe, this is the first objective.

The second objective was trade. The Africans had to be enslaved to produce raw materials on their own Land and that was sent to be transformed by Europe’s Industries, to develop European Industries and then the finished product had to be sent back, to be sold.

So Africa became a market for finished products but the producer of raw materials for European Industries. And another aim was, to transform the African societies to be appendages to the Europeans, it meant that missionaries were brought and the Africans had to be taught European languages and African culture, African Governmental systems were to be destroyed because they are primitive, backward and not fit.

But the aim was to take the African continent. Just like the Europeans who went to America, killed the Indians took their land and became United States of America. So, it was the same thing. But in the case of Africa, the Africans fought hard, shed their blood, up to today they are still shedding the blood to defend themselves despite of the defeat.

So, what was expected was the land, which serves for production, that’s a factor of production, the people which provided labour, that’s a factor of economic production and then the trade to sell this ( the finished products ) to the same people, which provided the capital and profit. That was what was expected. And of course more of this will be added as we go along.


Q: My next question is, as you have described in the historical developments, considering the amount of energy and resources Western Europe expended, in attempting to transform Africa into a new United States of America or Australia (as well as a massive slave plantation.) and viewing the failure of this due to the African resistance and revolutions , did these powers give up their plan or did it merely just change shape with the original idea put on hold or on pause until it was more expedient ?

Ans: Yes, this question is one of the deepest questions to be dealt with. It might even need a complete study and research to find out really what the proper answer is, but we can’t leave this to fate. We have to start to deal with it until we get the proper answer.

However the so –called independence given to the Africans, is to me what I call political independence whereby you raise the flag, there is a black man called president or prime minister or a king but the power remains with the Europeans. Up to today, as I am speaking. This is my belief, understanding and knowledge of it.

So, the decolonization of Africa from 1945 to 1960 which most Africans were given ( Ghana was the first black African country to get it, which was on the 5th march 1957 ) started from 1960 – 2000 except the state of Lado, which is not independent, Western Sahara, and St.Helena which are the three countries remaining.

But otherwise 53 African countries are politically independent but they don’t have sovereignty. The Characteristic of a state is that it has a people, it has land, defined land, you can see the border. The population is the people, territory is the land. But the territory is the political name, population is the political name. Then the third characteristic of a state is the organ.

Just as the heart is the organ that drives the body, a state is driven by an organ which we call government. The term government comes from greek kubernan which means to steer. So to call it government today, it is converted into Latin governor, that’s where the word government comes from and then the fourth characteristic for a state to exist is the human being to reflect or represent the country. It can be a King or Queen, it can be a President, it can be a Pope.

When you don’t have that sovereign representation, the sovereignty of your country goes to the country to whom you are placed under. If you take commonwealth countries, they are all placed under the King or Queen of Britain. Therefore sovereignty, external sovereignty is with the British.

You simply remain independent within commonwealth, which is like a province in a country. All decisions in external affairs, negotiated with other sovereigns, is done above you. So, if I come to conclusion on whether Europeans have given up power over Africa, I simply say No.

Of course very many people will shout and argue with me, that’s all right. But the truth is No. Technically No, Politically No, legally No. The second part of the question, are the Europeans continuing to hold on to that power, so as to control, to rule Africa as a continent, my answer is Yes, they are.

The latest evidence is in 1999, when they proposed the pretext to destroy African Unity which was giving African people a leeway to true independence, politically, economically and socially. They concocted the African Union based on the European Union and created something called NEPAD ( New Partnership for African development), which officially is supposed to be a partnership between Africa and Europeans. To me I call that domination.

Since the Africans did not understand, politically they are not mature and even if some are mature they only care for their stomachs, they went for it. So we are actually now in a period of recolonization.

The little bit of independence which came to African countries in the 60`s has now been taken but there are some people who think it is in the interest of Africa, No it is in the interest of Europe.

So I conclude, that is why I say we have to study this issue very much. Another example, right now, if you can allow me is the fact that there is no educational institution right now at the tertiary level ( University ) which is in an African language.

From south to North, East to West all higher education is either in French, in English, in Portuguese, in Spanish, or in Arabic. I haven’t known an African Language being used for the educational development of their young ones in African in higher institutions of learning.

That’s another typical example that Europeans want to keep the power over Africa. Perhaps even take the continent and plant non-Africans on the African continent. That is what some people say, the idea of AIDS was developed to destroy black Africans so that the land is left empty for non blacks in the long run.

But these are all debateable issues; I may not be very far from the truth when we find the truth. So, that is my view on that question.

The Name Sudan

The name ( SUDAN ) is being wrongly used and doesn,t reflect a Social -- way of life of SOCIETY - INDENTITY ---- The name Sudan in a broad sense refers in Arabic terms of language to blacks of Africa south of sahara - desert , i.e a vast extending area in a covering up belt from the West African coast of Atlantic ocean to the East African coast of Indian ocean . Within this belt region territory there have been and in history , lived human beings in organised social way of living life within the geographical areas of Nation - Countries or State - Kingdoms . The fall of the World's Super power
Pharaonic Rule collapsed definately with the rising Kingdoms of the North Africa : Egypt being divided into three kingdoms of Upper , Lower and Middle , and The Nuba people who fought along side the people of Lado , chose to settle around the foot hills of Mt Nuba territory becoming Kingdom of Nuba . Together with the Kingdom of Makuria they formed the Kingdoms of North Sudan . The Lado people moved onto settle on the foot hills of the mountain which they named Mt Lado in 687 b.c lying in the Sudan Central Africa with the southern tip end territory extending up to Lake Ombizako , name in Lui language of Lado , " today called Lake Albert in Central Africa " in a foreign language . Infact , and through out , mankind had to put an end to this trade . But surely the western world colonial powers played another dominant role in a different way and use of language pattern skills to do exactly what the Ottomans started and , that was to bring the whole territories of the Ottoman conquest under their domain . Destroy the Nation - Country - State kingdoms ,divide the land territories and give to them foreign names and let the people not know of their social way of living , tell them that they are not civilised in their way of life in a direction of education and use the same peope to plunder the natural resources from the Lands , yes , the truth is that the same blacks remained slaves on their own land ; having lost territorial integrity . The Berlin treaty of 26th feb, 1885 in history opened the chapter for this matter of the colonisation of Africa . The article 6 of the treaty is very clear on this issue . The Central - Africa ( Lado ) remained the biggest problem ever , since from 1885 till todate , because in a broad legal sense Lado people as a Nation - State refused and still reject to Sign to the former colonial and to the present forces which aspire still for the the overal a legitimate control of Central Africa - Lado . That means Lado has not been colonised by any foreign forces in accordance to the Berlin treaty as such . The Berlin treaty is still enforce as there is not yet a treaty signed like , of the Berlin conference which established the treaty itself , to cancel it . Colonial and present extra forces know more about this but unfortunately it seems most African community members of today may or may not know of this fact thus living Lado dissolve in nulla . Up to now there has still been no present African Nation - State as such , that has at least a courage to put to the International community ( such is to U.N ) to challenge the illegality of the Berlin treaty and its implications . May be , there is a definate answer to that when the present known Nation - states in Africa acquired their independences from the colonial powers in the most absurd incomprenhensible way which only favoured for a second time the application of the implication of the Berlin treaty . For the second time , all the , with few exception , African country leaders , in such away , only to attain indepedence obeyed to sign to live and exist under the power Authority ruling of the foreign powers and for them especially in making decisions in the wide and apart , complicated international political affairs which obviously remains beyond the capacity of these determined small subordinate nations . In international relations , these are described as countries with no Capacity and therefore no Soverenity . This is the reason why these independent African nations find themselves in difficulties to raise the issue of Lado affairs at an International confernce for discussions . Independence and freedom for Lado to be established according to the provvisions of the United Nations charter.

Where is Lado and her people in Africa now ?

The geographical area of Lado is located at the " White Nile " in the Nile - Congo Watershed Region , which also shares borders with Sudan, Central African Republic D R Congo, Uganda, Kenya and Ethiopia . But if you check your World maps, Lado is not found. The reason being that the West and the Europeans have pulled out Lado from the maps by stretching out the Lado country to Sudan, Uganda, the Congo and the Central African Republic countries . This prerogative objective was a master mind
complot and finally to result as a conquest and totally destruction of Lado as a people and Land . Done this from 1910 - 1914 , Britain and Lado entered into a military war battle with Lado which lasted for 5 years from 1914 - 1919 . The war came to a stop as peace agreement ( Truce ) was reached and signed by Britain and Lado in 1920 . A Senior Police High Commissioner in South Africa Mr E. Weatherhead , who indeed
participated in the Lugbari ( Lado ) British War from 1914-1919, was the British envoy sent to Odupi in Lado to sign this agreement on belhaf of the British Crown The British on the diplomatic character honoured to respect the existence of the State of Lado The Agofe / King of Lado signed the peace agreement for Lado As a legitimate recognition , the Agofe ( King ) of Lado was awarded the Merit of the highest Order in Council of the Queen ( The title O M. ) Mr E . Witherhead in turn was appointed then Governor General to represent th British Crown to Lado with Headquarters in the Capital of Lado , Arua. . One of the Cardinal out come of this truce was to prepare an understandable future diplomatic relations to be estabished between Britain and Lado and to find meaningful terms on the Water uses in question and particularly the uses of the water flows of the White - Nile river.( The Nile - Water diplomacy ) , as put it , " who controlls the entire Nile - Valley water flows from the source up to Egypt Nile delta , controlls Egypt " . look at maps , and you will find out that the bulk of the source of the Nile flow is the bolt - hold of the source by Lake Ombizako which the British named Lake Albert . Lado is the strategic Land to be under the supervision of Britain as she had already secretly occupied Egypt in 1882 .The other Western foreign powers of the world had to be pushed away from occupying Lado . By war or not Britain must take Lado as a
possession under the Crown of Britain . This is the leading chapter to the European and Western major conflict over Lado . For the best reasons known only to the Western European history writers , it is hard to find the name Lado being used in their writings . Lado is vaguely refered to as Side territory , That Area of Central Africa , and of course widely in use now , Lado is hidden under the collective term name of the Great Lake regions of Central Africa to suit the cause and the corse of events of the wars in Central Africa of which Lado is the heart . Lado and its history must not be known WITH SUCH REMARKS HISTORY : " King Leopoldo of Belgium , Head of the Free State of the Congo considered the Sudan territory of Side ( also known by the sweat Leopoldiano ) like part of his territory. When in 1881 the revolt of the Mahdi made loose to Egypt the control of Sweat, diverse Leopoldo sent to Side , expeditions and settled down a position in Lado . Agreements with Great Britain ( 12 of May and 14 of August of 1894 ) recognized the temporary possession to him of the territory called formally Side Enclave , separated from the province of Bahr el Ghazal. While this territory remains in being of the Free State of the Congo , it will have a special flag " The territory within the agreement was divided in two zones by the line of the 30 degrees : the western one would always belong to the Sovereigns of the Free State of the Congo and the Eastern one would be rented to the Sovereign and would return to British Sovereignty after the death of Leopoldo II.
After protests of France to Leopoldo II , it was agreed in turn that the territory to the East of the line of the 30 degrees was reduced to 15,000 miles square. This territory became the Enclave of Side ( although it was not an enclave ) , a seperate administration was established in the city of Side , Capital Lado . Great Britain in her pretext protested soon by the bad administration of the Territory by the Belgian King
Leopoldo II . King Leopoldo made as a donation the Congo Free State to Belgium, thus becoming a Colony ( The Belgian Congo ) in 1908. The population of Lado is estimated at 7 million souls It is composed of mainly Sudanics who are are divided into 29 ethnic - tribe groups ( Lugbari , Madi - Moru , Bari , Kaliko , Logo , Kebu - Ndu , Lendu , Avukaya , Gimara , Azande , Makaraka , Kuku , Gbaka and etc .......... The Alur - Jonam are the only non - Sudanic ethnic . They are a Luo ethnic The languages spoken in Lado are Lua , Lue , Lui , Luu and Luo tribes with afflilliation to the State of Lado . Specifically the spoken Lui language is understandable to all for communications .

: The Brussels treaty of 12 May 1894 was signed and for the first time , the term Lado Enclave figured out Lado enclave was to be for linking all the possessions of the British Crown from Cape Town in South Africa to Cairo in Egypt . 1894 June : The Brussels treaty of 12 May 1894 was denounced by the Belgium - British declaration of 22 June in favour of Germany . 1894 August : The Brussels treaty of 12 May was again denounced by the treaty of Paris of 14 , 1894 between France and Belgium . 1899 : France disengaged herself from the problems of Lado thruogh the Cairo treaty of 21 March 1899 , between Britain and France which was concurrently signed in Cairo ( Egypt ) and in London ( Britain ) by the French Ambassador Paul Gabon and

This treaty sanctioned the French to withdraw from the Nile Valley Conflict . 1904 : The treaty of the 8th April . 1904 between France and Britain : France undertook a commitment before Britain o adopt a neutral attitude over the question of Lado , meaning that when Britain is in war with Lado , France was not to help her against Britain in return for the British withdrawl from Moroco in favour of France . 1906 : Britain concluded another treaty , Treaty of London with Belgium on 9th May 1906 to obtain Belgium cooperation as a fellow Europeans to colonise Lado . In December 1906 a similar agrement was reached with Italy and successfully with Portugal , Spain and Germany all in all forcing these countries not to come into military help , assistance and not to trade with Lado . 1907 : In the same manner , in 1907 , Britain reached another agreement with Russia to obtain the Russian abstaintion from assisting Lado when at war with Britain in exchange for Iran which was important to Russia ( cf . - Arua treaty between Lugbari and Russia for mutual cooperation . ) . 1920 : From 1914 - 1919 , War broke up between Britain and Lado which in history is know as Lugbari - British war . It was fought for 5 years and ended in 1920 with the peace treaty signed at Odupi in Lado . There has been no treaty signed by Lado for recognition of the British Crown till todate . 1936 : From then 1926 there has been always tension between British occupant and Lado and again war broke out into the Kakua - kajo - keji war of between 1931 - 1936 . The war did not end until the United States ( U . S . A ) intervention by President Franklin D .
Rooesvert in 1936 . 1947 : The question of the colonisation of Lado was raised in the United Nations Organisation ( UNO ) – Trusteeship Council which the British wished to discuss with Uganda by the USSR . The citizens of Lado asked for freedom . 1948 : On the April of 1948 , the Keego / Prime Minister of Lado was assassinated by the British Colonial Authorities when he was to travel to UN for talks on Lado . ( intention was to hide the knowledge that Lado is a seperate State from Uganda since 1892 . ) . 1971 : Uganda ' s plot for the extermination came into picture in 1971 of the 1967 master plan to finalise but failed in carrying it out in January 1971 . The result came out of the over throw of the President of Uganda Mr Apollo Milton Obote ( a Luo trbe of Uganda State . ) . And by the Military hierachy Major General Idi Amin ( a Sudanic - Kakua by tribe from Lado ) took over the State Affairs of Uganda on 25th January 1971 ) . PATH – WAYS OF THE WARS OF LADO :


The European States divided the African Continent amongst them on 3 August 1875 . This is according to the (the Paris Resolution ) and again on 26 February 1885 (the Berlin Treaty ) where they took African Freedom and Liberty and imposed their Religion and their Values on the African Peoples .Nobody cared then that the African Continent consisted of Ancient Countries and Kingdoms which were much older and possessed a Richer Culture than that of the European States. The truth to tell is this , it is the British Occupation of LADO which Lado people have been fighting against up to till today and since from 1947 . Weatherhead ( nicknamed Nzerekede ) by Lado people , came to LADO twice only , whereby he took his wife Helen and his daughter Margaret there, who kept close relations to the LADO RoyalFamily up to the 1970 ' s . The LADO Issue, and the abominable treatment of the LADO People was close to Weatherhead ' s heart, and during his time as Police Commissioner of South Africa he drew up a Peace Agreement between LADO and England ( 1919-1920). Other British VIP ' s, like Governor-General, Sir Charles Gordon ( well known as China ) and Prime Minister Winston Churchill, also warmly supported the Independence of LADO, and as did Queen Elizabeth II in 1954 when she promised LADO Independence by May 1960 - but Powerful Political and Business Interests always stood in the way and blocked the Independence of LADO. The strong political view was seen and has not changed since then , is of the High
Commissioner of North - West India , Sir John Maffey who after leaving India was appointed Governor - General of Sudan and Lado to carry out that very same job to wipe out the Lado Royal family . the Lado Chiefs , and the Lado leaders and their families . The History of Lado and the People of Lado is characterised or indeed one , which is covered in , since theirs has always been a case of defending their Homeland and their Right to choose their own Way of Life on their own Land. The idea of this mission in Central Africa either came about at the instigation of Father Ryllo, a missionary in Syria, or thanks to the work of Father Casolani, a Maltese priest, who had made easier through his a special study of the geography of Cental Africa. Anyhow, Father Casolani was asked by the Propaganda Fide to furnish the urgently needed documentation regarding the unknown interior Sudan belt region of Africa. According to Casolani , there were two ways to penetrate into the interior Africa to reach the Central Heart of Africa : one leading from the Atlantic coast and the other from Northern Africa. Father Casaloni himself judged the road from Tripoli to be the safer one and therefore suggested that the Propaganda enlarged the existing Prefecture Apostolic of Tripoli with the Sahara, and to use the Prefecture as a base for further missionary undertaking. When he made clear that he would accept the leadership of a new expedition, he was appointed Vicar Apostolic of a new Vicariate. It became an independent circumscription, including also the Eastern areas of Sudan, bordering on the Vicariate Apostolic of Egypt and Arabia and the Prefecture Apostolic of Abyssinia : ( Brief: " Ex debito pastoralis officii " of Pope Gregory XVI, 3 April 1846 ). The erection of the vicariate, independent of the Prefecture Apostolic of Tripoli including the Eastern Sudan part came as a surprise. It was on 26 January 1846 that the Congregatio Generalis with the approval of Pope Gregory XVI decided to start a reconnoitering expedition in Sudan Central Africa . Nevertheless,the decree of erection was issued two months later, and this emphasized the clear intention of the Propaganda Fide to start the mission at once . Originally Casolani ' s attention was directed to the Western Sudan part of the Vicariate only ; he intended to explore the Kingdoms of Bournou, Niffe, Hausa, Bambara and the much - discussed town of Timbuktu . The inclusion of the eastern part brought about a change in his plans and he diverted his attention Eastward. He now considered the way along the Nile in order to reach South to Central Africa up to Lado territory easier than the route across the Sahara desert. Father Ryllo died, and was succeeded by Father IgnaceKnoblecher of the Austrian Instutute " Marien-Verein ", which adopted the mission and ent more missionaries as well as financial support. The missionaries on their move southwards succeeded in opening the centres at Khartoum, Gondokoro and Holy Cross , but all efforts proved to be in vain due to the loss of workers in the merciless conditions - whereabout there was already a great deal of Islamic influence . But Don Mazza of the Verona Institute came to the rescue, but could not last in the stay for long . In 1860 the Vicariate was in a desperate position, and the only solution to meet the desperate situation was judged to be the handing over of the mission to a religious congregation . As a last resort Propaganda fide called in once again the Franciscans to whom the vicariate was formally transferred in 1861. This too proved to be a make shift measure only and in 1866 the last station was closed . The Vicariate of Egypt took over the administration of the VicariateApostolic of Central Africa. The devoted service of half a generation of many a human life seemed to have ended in failure. In the same year 1866, Cardinal Lavigerie accepted the care of the western part of the vicariate, which became the Prefecture Apostolic of the Sahara . Msgr. Daniel Comboni became the champion of the cause of the Vicariate Apostolic of Central Africa ; he worked unceasingly for the reopening of the mission. Finally, in 1872, he and his followers of the Verona Institute
" pro missionibus apud nigritos " started work in the Re - established Vicariate, which had been reduced in size by the creation of the Prefecture Apostolic of the Sahara. The vast region area Sudan --- by the Decree of 14 Feb , 1911 , limited the nothern limits of the Prefecture Apostolic of Ubangi - chari extending it to the 13 degree N Lat . , the new territory being taken away from the Vicariate Apostolic of the Sudan
Central Africa. Futhermore re - organisation of Central Africa was done on May , 1913, whereby the Prefecture Apostolic of Bar – el - Gazal was newly formed by seperating it from the Sudan mission Central Africa once again ; by the Decree signed on 30 May , 1913 , thus the official name of the new mission changed to be the Vicariate Apostolic of Khartum. Yet , The Central Africa Vicariate remains the Vicariate Central Africa - ( Lado ) with Main Large Population of Catholic Faith and those of Ori Faith in common . There are no religious fights which go on in Sudan Central Africa in the plight as always is the propaganda by the western mass media to divide the thinking mind of the African people . This is done in an effort to create an Empty Territory in LADO for Foreign Settlement. One outstanding major Player in this Unjust and Inhuman Action against LADO is the Sudanese Peoples Liberation Movement ( SPLM ) which has been led by the late Colonel John Garang, a Dinka by Tribe from South Sudan State ( Upper Nile Region, Bahr-el-Ghazel Region and the Lake District Region ) . The SPLM got and gets a full Support from Britain - USA
through the Governments of Uganda and of Kenya. That is one of the Reasons why the President of Uganda is described as the " Darling of the West ". However it could have looked in hopes that the recent Agreement in 2003 , between the SPLM
and the Sudan Government should have resulted in a quick removal of all SPLM Bases on / in LADO Territory, the Repatriation of the South Sudanese Refugees from LADO Territory, and the Resettlement of the Displaced People of LADO. All the Displaced People of LADO had to return and resettle on their own Jorovu ( Tribal Lands in Ituri, Nile, Uele, Rohli, Yeyi and Kineti ) which are all on LADO Territory. The Lado people looked forward to the time when SPLM and Uganda woul stop to enslave and to kill the People of LADO with impunity with the full Blessings of their Super Power Allies . But not only that to Lado ' s expection , there have been plans to destroy only the State of Lado . Governments of Rwanda and of Uganda, in particular, have been supported ( Diplomatically, Politically, and Financially ) by Britain and the USA to Colonise the State of LADO so that the State of Lado is killed and removed as a Political Entity in Central Africa. And then the Territory of LADO is to be shared among Uganda, Rwanda, and Sudan on behalf of Britain and their Allies who are very much against the Existence of the State of LADO as a Political Entity in Central Africa. ( God or the Devil may know why the Anglo-Saxon World does not want to see LADO as a Political Entity ) . For the last fifty-seven (57) years the People of LADO have been living as Refugees, Displaced Persons on their own Land and as Stateless Persons. They have been killed with impunity by some Governments of the Neighbouring / Surrounding Countries. There have been Plans to Exterminate Millions of some of the People of LADO, in order to take the Territory of LADO, especially by Uganda, since 1967, and Rwanda (1997) whose Troops are / were under the Command of British and European Officers . For the last 20 (1980) years the Foreign Troops have roamed LADO Villages, Settlements and Towns , killing with impunity under the Nose and Eyes of the UN. No less than 4 million People of LADO have been killed since then. The many Wars and Armed Conflicts raging on the African Continent, in Congo-Zaire, in Sierra Leone, Liberia and between Ethiopia and Eritrea are Remnants of the European Partitioning of the African Continent splitting Kingdoms, States and People regardless of their Cultural or Ancestral Background, The present National Entities and their Borderlines are not Natural but have instead resulted in a number of Artificially Created States inhabited by People of Different National and Cultural Heritage.
